Disclosure Statement on the Protection of Visitor and Member Personal Data

Dear Visitors and Members,

We would like to inform you about the personal data we process as Heysengo Labs Inc. ("Heysengo"), in the capacity of "Data Controller" within the scope of our practices regarding the processing of your personal data and Law No. 6698 on the Protection of Personal Data (the "Law").

This statement covers:

  • your visiting the websites at www.heysengo.com and all its subdomains (the "Site"), or your use of the web application named Heysengo accessed via the Site (the "Web Application"),
  • your use of the personal website creation service in different colors and designs with different language options via the Site/Application, connecting to your existing domain if any, obtaining a new domain if none exists, creating a dedicated QR code for the website, integrating the website owner's listing portal with their stores, and your benefiting from our other support related to the services you will offer your customers,
  • your becoming a Member via the Web Application ("Member"),
  • your consent to the sending of commercial messages and general/special campaign notifications through commercial communication channels,
  • our mutual communication through contact channels

the disclosure statement regarding the use of your personal data in such cases is set out below.

1What Are Our Purposes for Processing Your Personal Data and Which Personal Data Do We Process?

Site/Application Visit

We process your usage information of the Site and Application in order to detect and resolve technical/software errors and deficiencies encountered during your visit to the Site and Application.

Membership (membership on the Web Application/Mobile Application)

  • your identity (first name, last name), contact (email address, phone number, address), personnel (workplace information) and password data, for the purposes of enabling membership procedures, fulfilling the requirements of the membership agreement to be concluded with you, enabling member login and providing membership notifications,
  • your identity, contact and invoice data, and additionally some extra invoice data if you are a taxpayer, for the purposes of issuing invoices for service fee payments made in return for the services you can benefit from with membership and sending the e-invoice to you,
  • your credit card data for the purpose of collecting payment if service fee payments are made by credit card (credit card information is transferred to the payment institution without being stored by us),
  • your identity and contact data, so that you can proceed using your member information without having to re-enter it each time you log in to the Site/Application as a member,
  • depending on your preference, your identity, personnel, professional experience and visual data along with information about your social media accounts, for the purpose of personalizing your profile account and learning more about you after the membership creation process is completed,
  • your marketing data for the purposes of enabling you to benefit from special membership programs, take advantage of offers and opportunities specific to you, and creating personalized campaigns, advantages, promotions and advertisements, as well as segmentation, reporting, profiling, marketing and analysis activities

Commercial Communication Processes

If you give commercial communication permission/explicit consent, we process your identity (first name, last name) and contact (phone number, email address) data for the purposes of carrying out commercial communication activities directed at you (SMS, email, calls, etc.) with general or personalized campaigns, advantages, promotions, advertisements, notifications and marketing activities created within the scope of Membership, and transmitting our customer-satisfaction surveys regarding our products and services and our invitations to campaigns, contests, raffles, openings and other events.

Call Center/Customer Relations Processes

If you contact us through our communication channels (call center, email, Site, Application, social media, online messaging/voice call applications, etc.), we process your identity, contact, customer transaction, visual record and, where necessary, legal transaction data in order to resolve the problems and complaints you convey to us, answer your questions and contact you regarding these when necessary; we also process your call center voice recordings to be used within the scope of our customer-satisfaction efforts and as evidence in any disputes that may arise between us.

Legal Processes and Internal Activities

We process your identity (first name, last name), contact (phone number, email address), invoice (billing address), transaction security (log records) and other data related to the service received, for the purposes of fulfilling our obligations arising from legislation and our other legal obligations towards authorized and competent public institutions and organizations.

We process your identity, contact, invoice, transaction security and legal transaction data for the purposes of exercising all kinds of litigation, response and objection rights against official institutions and organizations such as courts, enforcement offices and arbitration committees in disputes that may arise, conducting negotiation and settlement processes regarding disputes, delivering the necessary information to you if you request it, and within the scope of internal audit, internal control and reporting, testing, development and improvement work.

We process your identity, contact, transaction security and credit card data (only the first 6 and last 4 digits) along with other data related to the service received, in order to prevent use of membership agreements contrary to legislation and morality, detect suspicious transactions and unlawful use, and perform blocking and unblocking operations.

2To Whom and For What Purpose Can We Transfer Your Personal Data?

We share your personal data;

  • with our company's domestic service providers and business partners, for the purposes of receiving product and service support on matters such as information technologies, marketing/advertising/analysis activities, logistics services, payment services or expertise-requiring consultancy, etc.,
  • with the said institutions, organizations and authorities, for the information requested from us in order to fulfill our information- and document-provision and other related obligations towards authorized public institutions and organizations and judicial authorities, and to exercise our legal rights such as litigation and response rights,
  • with the suppliers from whom we receive consultancy services where necessary and the payment institutions related to the relevant transaction, for the purposes of monitoring and detecting suspicious transactions and preventing unlawful transactions,
  • with our business partners within the scope of activities related to increasing visit traffic on the Site and Application

we share.

In addition, if you give explicit consent, we share your identity, contact, invoice, marketing, customer transaction and transaction security data abroad — with service providers and business partners located abroad for the purposes of receiving product and service support on matters such as information technologies, marketing/advertising/analysis activities or expertise-requiring consultancy and similar subjects, within the scope of the agreements we make with them and to fulfill the requirements of such agreements, or because the servers of the relevant domestic and/or foreign suppliers are located abroad for these purposes.

3What Is the Method and Legal Basis for Collecting Your Personal Data?

We collect your personal data through automatic or non-automatic methods such as: recording into our systems the other information you share regarding the services to be benefited from in return for membership or membership transactions; recording into our systems the data generated/obtained from the use of your fixed-mobile internet and communication devices and/or applications in various environments and places; recording into our systems the information you report through communication channels; cookies and similar other technologies running on the Site/Application as explained in detail in our cookie disclosure statement; recording the requests and complaints you convey to us during mutual communication through contact channels; and recording your conversations with the call center.

We collect your personal data based on the legal grounds of "the necessity of data processing for the establishment and performance of a contract", "the fulfillment of a legal obligation" and "the necessity of data processing for the legitimate interests of the data controller" regarding service procurement on the Site/Application; "the fulfillment of a legal obligation" regarding our retention obligations arising from legislation; "the necessity of data processing for the establishment and performance of a contract" and your "explicit consent" regarding Membership processes; "the necessity of data processing for the establishment and performance of a contract" and "the necessity of data processing for the legitimate interests of the data controller" regarding Call Center/Customer Relations processes; and "the existence of the explicit consent of the relevant person" regarding commercial communication processes.

You can end personal data processing activities based on explicit consent at any time and without showing any reason by withdrawing your explicit consent.

4What Are Your Rights?

You can always apply to us regarding your rights set out in Article 11 of the Law concerning the personal data we process.

You can submit your applications to Heysengo Labs Inc. as the Data Controller by sending an email from the email address registered in our system.

(We would like to remind you that the relevant request must comply with the conditions set out in the Communiqué on the Procedures and Principles of Application to the Data Controller.)
