1. Why is there no statutory right of withdrawal?
You get access to heysengo Hey Click as soon as payment is confirmed. The content is provided over the internet instantly. Contracts of this kind are among the exceptions listed in Distance Contracts Regulation, art. 15(1)(ğ): "services performed instantly in electronic form or intangible goods delivered instantly to the consumer". For this reason, you have no 14-day statutory right of withdrawal.
When you place the order, you confirm this separately. If you do not confirm, the order is not completed. Your confirmation is recorded with your order, together with the version of the text you confirmed and the time of confirmation.
The sentence you tick when you place the order:
I want access to the Hey Click content to start immediately after payment. Because digital content is supplied immediately, I understand and accept that I have no statutory right of withdrawal under art. 15(1)(ğ) of the Turkish Distance Contracts Regulation. heysengo's 7-day voluntary refund guarantee still applies.
2. Voluntary refund guarantee
Although there is no statutory right of withdrawal, we want you to try the course. For this reason, we give the following guarantee. This guarantee is not a statutory right of withdrawal. It is a commercial refund guarantee that heysengo gives voluntarily.
- Period. You apply within 7 days of the purchase date.
Usage limit. At the time you apply, you must have opened no more than 10% of the paid lessons in the package you bought.
- Opening a lesson once counts that lesson as "opened".
- Free preview lessons that are open to everyone are not included in this ratio.
- The ratio is the number of paid lessons you opened divided by the number of paid lessons in the package, and it must not exceed 10%. For example, at most 5 lessons may have been opened in a 50-lesson package, and at most 4 lessons in a 45-lesson package.
- Amount. If the conditions are met, we refund the full price. We do not ask for a reason.
- Application. Write to destek@heysengo.com from the email address in your account and state your order number. We reply to your application within 3 business days at the latest.
Refund method.
- If you paid by card through Dodo Payments, Dodo makes the refund on heysengo's instruction. The amount returns to your card or to the payment method you used. The time it takes to appear on your card depends on your bank.
- We initiate the refund within 14 days at the latest from the day we approve it.
- Access. When the refund is made, your access to this package ends.
- Once only. The guarantee applies once per person for the same course. If you receive a refund and then buy the course again, the second purchase is not covered by the guarantee.
3. When the guarantee does not apply
The guarantee does not apply in the following cases. Even in these cases, your statutory rights are reserved.
- More than 10% of the lessons in the package have been opened.
- There are concrete indications that the content has been copied in bulk or that the account has been shared. Examples: many lessons opened in a short time, simultaneous sessions from different countries. In such a case, we notify you in writing of the reasons for our decision.
- The application is made after 7 days.
4. Defective performance
This section is separate from the voluntary guarantee and is not limited by it. If you could not access the content at all because of a technical problem on our side, or if the content you bought differs materially from what the product page described, the 7-day and 10% conditions do not apply. You can exercise your statutory rights.
5. Chargeback
For an order paid by card, please write to us or to Dodo before you dispute the charge with your bank. Dodo's buyer terms require you to contact Dodo before a dispute. Contacting us before a dispute speeds up the refund.
